Welcome to PoemHaven. PoemHaven is operated by the “PoemHaven Operator.” These Terms of Service (“Terms”) constitute an agreement between you and the PoemHaven Operator regarding your access to and use of the PoemHaven website, community, publication submission services, creative tools, and related services.

1. Acceptance of Terms and Age Requirements

  1. Before registering, signing in, or using any feature that requires an account, please carefully read these Terms, the PoemHaven Privacy Policy, and the AI-Assisted Moderation and Content Processing Notice.
  2. By checking the box indicating your agreement and completing registration, you acknowledge that you have read, understood, and accepted these Terms and confirm that you are at least 14 years old.
  3. Individuals under the age of 14 may not independently register for a PoemHaven account. PoemHaven currently does not provide an online parental or guardian consent process or an age-verification process. If you do not meet the age requirement, please do not register for or use account-based features.
  4. If you use PoemHaven on behalf of an organization, you represent that you have the legal authority to accept these Terms on behalf of that organization.

2. Accounts and Security

  1. You must provide accurate and up-to-date registration information that can reliably receive security notifications. You are responsible for safeguarding your password, email verification codes, two-factor authentication keys, and recovery codes.
  2. You may not transfer, lend, or sell your account, impersonate another person, or use automated methods to create accounts in bulk.
  3. If you discover that your account has been compromised or is being used in an unusual or unauthorized manner, you should notify the PoemHaven Operator as soon as possible through the contact channels provided on PoemHaven.
  4. When necessary to protect system security, investigate suspected violations of law or these Terms, or protect your account, PoemHaven may require additional identity verification, restrict high-risk actions, or temporarily suspend access to your account.

3. Creative Works, Publishing, and License

  1. You retain all rights you are legally entitled to in poems, comments, replies, submissions, profile images, photographs, and other content that you submit to PoemHaven, and you represent that you have the right to publish such content.
  2. You retain the copyright in your content. To enable PoemHaven to store, display, format, distribute, back up, search, moderate, recommend within the service, and generate equivalent Simplified and Traditional Chinese versions of your content, you grant PoemHaven a non-exclusive, worldwide, royalty-free license, with the right to sublicense solely to service providers as necessary for technical purposes. This license is limited to what is reasonably necessary to operate, maintain, improve, and protect the PoemHaven services.
  3. Simplified and Traditional Chinese derivative versions are provided solely to improve readability for users with different Chinese writing preferences. They do not replace the original work or alter ownership of rights in the original work. Where available, PoemHaven will identify a version that is not the original and provide access to the original text. Authors may use available product controls to stop displaying derivative versions or report problems with them.
  4. After you delete or withdraw content, PoemHaven will stop publicly displaying it in accordance with available product functionality and applicable law. Reasonable quotations already made by others, discussion records, security backups, or records that must be retained by law may not disappear immediately.
  5. Decisions regarding the acceptance, rejection, editing, scheduling, or publication of submissions to PoemHaven publications are made by human editors. AI does not determine whether a submission is accepted or rejected.

4. Community Rules and Prohibited Conduct

When using PoemHaven, you may not:

  • Post unlawful content or content that infringes another person’s copyright, privacy, reputation, or other legal rights;
  • Engage in threats, harassment, hateful conduct, fraud, malicious traffic diversion, spam, or attempts to circumvent moderation;
  • Access another person’s account without authorization, probe or attack PoemHaven systems, or maliciously consume computing or network resources;
  • Exploit vulnerabilities, automated scripts, or fraudulent interactions to manipulate view counts, reputation, levels, recommendations, or moderation outcomes; or
  • Use PoemHaven for activities prohibited by applicable law or for purposes clearly outside the ordinary scope of poetry creation, literary discussion, and community participation.

PoemHaven may take actions under its published rules, including hiding content, requiring changes, restricting functionality, issuing warnings, limiting posting privileges, suspending accounts, or deleting accounts. If you disagree with an automated moderation or enforcement decision, you may request human review through the appeal, report, or contact channels provided within PoemHaven.

5. AI-Assisted Moderation and Content Processing

  1. Within the scope enabled by PoemHaven administrators, PoemHaven may use automated rules and third-party AI services to assist in identifying unlawful, harmful, harassing, fraudulent, or otherwise prohibited content.
  2. For content types expressly enabled by administrators, PoemHaven may also use local character conversion or third-party AI services to generate equivalent Simplified or Traditional Chinese derivative versions. Simplified/Traditional Chinese conversion of private messages is performed locally on PoemHaven’s servers and is not sent to third-party AI services for this purpose.
  3. The specific purposes of AI processing, categories of data involved, possible cross-border processing, retention practices, human review procedures, author controls, and effects of withdrawing consent are described in the AI-Assisted Moderation and Content Processing Notice. Where required, you will be asked to provide separate, explicit consent.
  4. If you withdraw consent to AI processing, your account will be placed in read-only mode. You may continue to read and manage existing content to the extent permitted by law and available product functionality, but you may not create or modify content that requires moderation. You may resume creating content after agreeing again to the then-current version of the applicable AI processing terms.

6. Service Changes, Interruptions, and Termination

  1. PoemHaven will make reasonable efforts to maintain the security and reliability of its services but does not guarantee that the services will always be uninterrupted, error-free, free of data delays, or unaffected by failures of third-party services.
  2. PoemHaven may modify, suspend, or discontinue certain features due to maintenance, security incidents, force majeure events, applicable legal requirements, or changes to third-party infrastructure. Where reasonably practicable, PoemHaven will provide advance or timely notice.
  3. You may stop using the services at any time and may request deletion of your account or personal information through available product functionality or the contact channels provided by PoemHaven. Deletion requests may require identity verification and may be subject to applicable retention obligations, dispute-resolution needs, and security-audit requirements.

7. Limitations of Responsibility

  1. User-generated content on PoemHaven represents the views of the individual who posted it and does not represent the views of the PoemHaven Operator. You are responsible for independently evaluating the accuracy, completeness, and suitability of such content.
  2. To the extent permitted by applicable law, PoemHaven is not responsible for offline transactions between users, third-party links, the independent actions of third-party service providers, or losses arising from circumstances beyond PoemHaven’s reasonable control.
  3. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, nor does it affect any rights that users are entitled to under applicable law.

8. Changes to These Terms and Notices

  1. PoemHaven may update these Terms in response to changes in features, processing activities, or applicable laws and regulations. Each update will be published as a new version and will not overwrite previous versions.
  2. If an update materially affects users’ rights or obligations, PoemHaven will provide notice through an in-site notification, pop-up notice, system announcement, or another appropriate method. You will be required to review and accept the new version before continuing to create or modify content. Until you accept the updated Terms, you may continue to read and manage your existing content.
  3. Historical versions of these Terms and records of the corresponding dates and times of acceptance may be retained for auditing and dispute-resolution purposes.

9. Governing Law and Dispute Resolution

The formation, performance, and interpretation of these Terms are governed by the laws that have an actual and substantial connection to the relevant services and the parties involved.

In the event of a dispute, the parties should first attempt to resolve the matter through good-faith consultation. If the dispute cannot be resolved through consultation, either party may seek relief before a court of competent jurisdiction or another legally authorized dispute-resolution body.

Where applicable law provides mandatory consumer-protection rights, choice-of-law rules, or jurisdictional requirements, those mandatory provisions will apply.

10. Contacting the PoemHaven Operator

If you have questions about these Terms, an action taken against your account, or your rights as a user, you may contact the “PoemHaven Operator” through the reporting, appeal, or other contact channels provided within PoemHaven.

PoemHaven may require reasonable identity verification before processing requests involving accounts, personal information, or other protected user rights.
